These Terms of Use (“Terms”) govern your use of the Somnest app (“the app”, “we”, “us”). By downloading or using the app, you agree to these Terms. If you do not agree, please do not use the app.
Eligibility
You must be able to form a legally binding agreement to use the app. The app is not intended for children under 13, and they should not use it.
The service
Somnest helps you track your sleep and understand your bedroom environment, and it suggests abstract product categories that may make your room easier to sleep in. Suggestions are general categories (for example, “blackout curtains”), not specific products, brands, prices, or endorsements. The app is provided free of charge; there are no subscriptions and no in-app purchases.
Not medical advice
Somnest is a wellness and lifestyle tool, not a medical device. It does not diagnose, treat, cure, or prevent any condition, and it does not provide medical advice. Its sleep insights and bedroom observations are intended for general comfort and habit-building only. Always consult a qualified professional about any health concern, and do not rely on the app for medical decisions.
AI-generated analysis and suggestions
Bedroom analysis and suggestions are produced by an automated AI system and may be inaccurate, incomplete, or unsuitable for your situation. They are suggestions only; use your own judgement before making a purchase or changing your environment.
Affiliate links
The app contains Amazon affiliate links. Tapping a suggestion opens an Amazon search page in your browser that includes our affiliate tag. As an Amazon Associate, we may earn from qualifying purchases. We do not control and are not responsible for products, prices, availability, content, or transactions on Amazon; those are subject to Amazon's own terms and policies.
Third-party services
The app relies on third-party services, including Amazon (affiliate product search) and Google (the Gemini API for analyzing bedroom photos, and Firebase for anonymous authentication, analytics, and crash reporting). Your use of features that depend on these services is also subject to those providers' own terms and privacy policies.
Acceptable use
You agree not to misuse the app, including: interfering with or disrupting the service or our backend; attempting to bypass rate limits or security measures; reverse-engineering the app except where permitted by law; or using the app for any unlawful purpose.
Intellectual property
The app, together with its design, brand, and content (excluding third-party content), is owned by us or our licensors and is protected by applicable laws. We grant you a limited, personal, non-transferable, revocable license to use the app for its intended purpose.
No warranty
The app, its analysis, and its suggestions are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, or availability. We do not warrant that the app will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of (or inability to use) the app, including any purchases you make on Amazon or other third-party services.
Changes
We may update these Terms from time to time. The “Last updated” date above reflects the latest version, and your continued use of the app after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the applicable laws of our principal place of business, without regard to its conflict-of-laws rules.
